This session provides BC Notaries with a practical overview of the Cowichan Tribes decision, the legal principles affirmed by the courts, and their relevance to conveyancing, land use, and due diligence. 

Participants will review the interaction between Aboriginal rights and title, provincial land interests, and third-party property transactions, with a focus on identifying potential risks and practice considerations. The session is designed to help notaries recognize when heightened awareness or further legal advice may be required and to incorporate these developments into everyday practice in an informed and responsible manner.

One increasingly common approach is adding a family member to title with 1% ownership to help meet financing requirements. While this method can solve short-term qualification issues, it introduces significant legal, financial, and estate-related complexities that many consumers — and even professionals — misunderstand. 
 
This session explores the new reality of home ownership in a multi-party, hybrid-ownership era. Participants will learn the legal implications, risks, documentation challenges, and the role of Independent Legal Advice (ILA).

  • Explain why 1% ownership structures are becoming increasingly common. 
  • Identify the legal consequences of adding a family member to title with minimal ownership.
